Terms of Service

By downloading, installing, or using the Burn2Earn mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Levelapp SRL ("we", "us", or "our").

If you do not agree to these Terms, do not use the App.

You must be at least 18 years old to use Burn2Earn. By using the App, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts of users who misrepresent their age.

Burn2Earn is a fitness rewards application that allows users to:

• Track physical activity (steps, calories, active minutes) via Apple HealthKit or Google Fit
• Earn Burn2Earn Points by completing fitness challenges
• Redeem points for gift cards and products from our Store
• Purchase optional subscriptions (Basic and Premium) for enhanced features
• Maintain a fitness streak and purchase streak freezes

We reserve the right to modify, suspend, or discontinue any feature of the App at any time with reasonable prior notice.

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at office@burn2earn.com if you suspect unauthorised access.
• You may not share your account with others or create multiple accounts to circumvent limitations.
• You may delete your account at any time from the Profile → Account Data screen.

• Points are earned by completing fitness challenges as measured by the App.
• Points have no cash value and cannot be exchanged for money.
• Points are non-transferable between accounts.
• Points may expire if your account is inactive for more than 12 consecutive months.
• We reserve the right to adjust point values, earning rates, and redemption conditions with 14 days' notice.
• Points earned through fraudulent activity (e.g., manipulated fitness data) will be forfeited and may result in account suspension.

• All payments are processed securely by Stripe. We do not store your card details.
• All prices are displayed inclusive of applicable VAT.
• For digital goods and in-app purchases, you acknowledge that delivery is immediate upon purchase. By making a purchase, you waive your right of withdrawal under EU consumer law (Directive 2011/83/EU, Art. 16(m)), except where required by applicable law.
• Refund requests for exceptional circumstances can be submitted to office@burn2earn.com. We will evaluate each request on a case-by-case basis.

Burn2Earn is not a medical application and does not provide medical advice.

• The App is for fitness tracking and motivation purposes only.
• Point calculations are based on data reported by your device sensors. We are not responsible for inaccuracies in sensor data.
• You should consult a healthcare professional before starting any new fitness program.
• We are not liable for any injury, health issue, or damage resulting from physical activity undertaken in connection with using the App.

You agree not to:

• Manipulate, fake, or artificially inflate fitness data to earn points fraudulently
• Use bots, scripts, or automated tools to interact with the App
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Circumvent any security measures or rate limiting
• Use the App for any unlawful purpose
• Impersonate another user or person
• Share, sell, or transfer your account to another person

Violation of these rules may result in immediate account suspension or termination, forfeiture of all accumulated points, and potential legal action.

All content in the App — including but not limited to text, graphics, logos, icons, and software — is the property of Levelapp SRL and is protected by Romanian and EU intellectual property law. You may not reproduce, distribute, or create derivative works without our express written consent.

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You will receive notice where reasonably practicable. Upon termination:

• Access to the App and all accumulated points will be revoked immediately.
• Active subscriptions will be cancelled without refund for the remaining period, unless termination was due to our fault.
• You may appeal a termination decision by contacting office@burn2earn.com.

To the maximum extent permitted by applicable law, Levelapp SRL shall not be liable for:

• Indirect, incidental, or consequential damages arising from your use of the App
• Loss of data, points, or rewards due to technical issues beyond our reasonable control
• Interruptions to the service due to maintenance, outages, or force majeure events

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Romanian/EU law.

We may update these Terms from time to time. We will notify you of material changes via push notification or email at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Romania and applicable EU regulations, without regard to conflict of law principles.

Any disputes arising from these Terms shall first be attempted to be resolved amicably by contacting office@burn2earn.com. If a resolution cannot be reached within 30 days, disputes shall be submitted to the competent courts in Romania.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
